VARIANCE NO. 99-03 <br />Filed by W.A. Dampf Builders to re-establish a substandard drive-through lane at a vacant restaurant located <br />at 724 North Bristol Street in the Specific Development 1 zoning district. <br />LEGALLY NOTICID: May 14, 1999 <br />PUBLICLY NOTICED: May 14, 1999 <br />RECOMMENDATION: <br />1. Adopt a resolution denying Variance No. 99-03. <br />2. Receive and file the Categorical Exemption for Environmental Review No. 98-173. <br />Mr. Jeffry Rice, Principal Planner, presented the staff report and recommendation. <br />Commissioner Doughty stated that due to a conflict of interest, she would be abstaining from the item. <br />Mr. Ghanshiyan Lohiya, applicant, submitted a letter regarding the financial analysis and feasibility of <br />having adrive-through lane at the restaurant; informed the Commission that he had bought the property <br />approximately one year ago; that when he had purchased the property, he had intended to open the <br />restaurant with adrive-through lane. In addition, he stated that he believed the restaurant would attract <br />drive-through patrons with a minimal amount of pedestrian traffic. He further stated that in order to <br />accommodate the vehiculaz patrons, he would be willing to not have a Bristol Street exit. <br />Commissioner Verino asked the applicant if he was awaze of the drive-through requirements when he <br />purchased the site. Mr. Lohiya stated that he was not aware of the requirements. <br />Commissioner Richazdson asked how long the restaurant had been out of use.
