3. Recommend that the City Council adopt a resolution approving Tentative Tract Map No. 15805 as <br />conditioned. <br />4. Recommend that the City Council approve and certify the Negative Declaration for Environmental <br />Review No. 99-01. <br />Mr. Jeffry Rice, Principal Planner presented the staff report and recommendation. <br />Mr. Richazd Cisakowski, representating Pazagon Homes, described the proposed paired homes. <br />Commissioner Cribb and Solorio noted that the rendering illustrated additional landscaping that that was <br />required in the specific development and Commissioner Solorio requested the rationale behind the homes <br />being a gated community. <br />Mr. Richard Cisakowski, stated the market demand was for gated communities and he was not prepazed to <br />negotiate regazding the additional landscaping on the applicant's behalf. However, he emphasized to the <br />Commission that most homeowners were willing to personalize and provide additional front yazd <br />landscaping than what was proposed by the applicant. <br />Commissioner Richazdson inquired regazding the railroad spur line on the adjacent school district property. <br />In addition, he expressed concern over what measures had been taken to ensure that it would not have heavy <br />usage in the future and requested staff to pursue the abandonment of the line with the railroad and merger <br />with the district property. <br />Motion to: 1) recommend that the City Council adopt an ordinance approving Amendment Application <br />No. 99-03; 2) recommend that the City Council adopt an ordinance approving Specific Development 68 <br />with the modification for the applicant to provide two 24 inch box canopy trees on each lot; 3) recommend <br />that the City Council adopt a resdution approving Tentative Tract Map No. 15805 as conditioned; and 4) <br />recommend that the City Council approve and certify the Negative Declaration for Environmental Review <br />No. 99-OZ. <br />MOTION: <br /> <br />AYES: <br />NOES: <br />ABSENT: <br />ABSTAINED: <br />Solorio <br />Doughty, Solorio, and Richardson <br />Mondo and Cribb <br />Verino, and Nalle <br />None <br />SECONDED: Doughty <br />3. APPEAL OF THE ZONING ADMINISTRATOR'S ACTION NO. 99-01 AND CONDITI NAL USE <br />PERMIT NO. 99-02 <br />Filed by Mc Wannis Loy Abajian to appeal the Zoning Administrator's action not to allow a Type 20 <br />Alcohol Beverage Control License in order to sell beer and wine for off-premise consumption located at <br />2801 South Bristol Street in the General Commercial (C2) zoning district. <br />(Set for public hearing by the Zoning Administrator) <br />LEGALLY NOTICID: April 30, 1999 <br />PUBLICLY NOTICED: May 4, 1999 <br />RECOMMENDATION: <br />Adopt a resolution denying Conditional Use Permit No. 99-02. <br />2.. Receive and file the Categorical Exemption for Environmental Review No. 98-146. <br />Ms. Lynnette Perry, Associate Planner, presented the staff report and recommendation. <br /> <br />Mr. Fred Pardes, Attorney representing the application, emphasized to the Commission that the mazket was <br />primazily a food mazket with ancillary liquor sales and that less than two percent of the floor space would be <br />for alcohol sales. In addition, he informed the Commission that the applicant was in escrow for purchasing <br />a Type 21 alcohol license from Lucky's and the applicant was willing to downgrade the license; and he <br />referenced a petition that was submitted to the Zoning Administrator in support of the alcohol license. <br />Commissioner Mondo referred to the Mazch 31, 1999 Zoning Administrator heazing and asked if the <br />applicant planned to upgrade to a Type 21 license after two yeazs and that it was stated at the heazing that <br />the market would not be able tq remain open iP the license was not kranted which indicated a si~nificanc® to <br />the liquor sales at the location. <br />Planning Commiaeion Minu[es <br />May 10, 1999 <br />
