CONDITIONAL USE PERMIT NO. 89-22 <br />Filed by the City of Santa Ana to review Conditional Use Permit No. 89-22 and modify the conditions of <br />approval for Filibertos Restaurant located at 762 South Harbor Boulevard in the Hazbor Specific Plan (C2) <br />zoning district. <br />LEGALLY NOTICED: January 16, 1999 <br />PUBLICLY NOTICED January 15, 1999 <br />RECOMMENDATION: <br />Adopt a resolution modifying the conditions of approval for Conditional Use Permit No. 89-22. <br />Mr. Sergio Klotz presented the staff report and recommendation. <br />The applicant had no comments. <br />The following public members spoke in favor of staff's recommendation and expressed concerns with the <br />criminal activity in the area: <br />Dave Lopez <br />' David Murray <br />There were no opposing comments. <br />Motion to adopt a resolution approving Conditional Use Permit No. 89-22 with the modification that the <br />conditional use permit be reviewed at six months and one year thereafter. <br />MOTION: Richardson SECONDED: Doughty <br />YES: Verino, Mondo, Doughty, Nalle, Solorio, and Richazdson <br />NOES: None <br />ABSENT: Cribb <br />ABSTAINED: None <br />2. ABANDONMENT NO. 98-07 (Jeffry Rice) <br />Filed by Mr. Kris Kakkaz to vacate an alley between Main Street and Cypress Avenue in order to develop a <br />retail facility located at 1015 South Main Street in the Community Commercial (C1) zoning district. <br />LEGALLY NOTICED: January 19, 1999 <br />PUBLICLY NOTICED January 20, 1999 <br />RECOMMENDATION: <br />Recommend that the City Council adopt a resolution approving abandonment of an alley between Main <br />Street and Cypress Avenue. <br />Mr. Jeffry Rice presented the staff report and recommendation. <br />Mr. Ernie Estrada, General Partner, displayed a rendering of the proposed project and informed staff that <br />the staff report indicated the applicant as Kris Kakkar and stated that Mr. Kakkaz was only a limited partner. <br />In addition, Mr. Estrada stated that he would like to demolish two homes on the property in order to develop <br />a retail facility and that he had rehabilitated many structures in the City. <br />The Commission asked the applicant if any formal lease agreements had been signed, if he was the owner of <br />the La Tienda, if there was any proposed landscaping in the rear of the retail facility, if the applicant had <br />3 <br />
