C. APPEAL OF THE PLANNING MANAGER'S DECISION N0.2001-02 <br />Filed by Mr. Salvador and Ms. Judy Pena to appeal the Planning Manager's decision to <br />deny a room addition to an existing single-family residence located at 1435 South Birch <br />Street in the Single-Family Residential (R1) zoning district. <br />RECOMMENDATION: <br />C <br />Deny Appeal of the Planning Manager's Decision No. 2001-02. <br />Ms. Irma Hernandez, Assistant Planner I, presented the staff report and <br />recommendation. <br />Mr. Joe Gergan, representing the applicant, provided comments in support of the <br />applicant's request; and informed the Commission that the local neighbors supported the <br />request; and requested that the Commission accommodate the applicant's request by <br />applying conditions. <br /> <br />Mr. Harry Monck, representing the applicant, provided comments in support of the <br />request. <br />Commissioner Doughty requested staff work with the applicant to develop an acceptable <br />plan. <br />Motion to continue Appea! of the Planning Manager's Decision No. 2001-02 to April <br />23, 2001. <br />MOTION: Doughty SECONDED: Richardson <br />Mr. Adams informed the Commission that the applicant indicated that he wanted approval <br />of the plans submitted and staff believed the continuance would not resolve the issue. <br />Commissioner Doughty rescinded her motion to continue the Appeal of the Planning <br />Manager's Decision No. 2001-023. Commissioner Richardson rescinded his second of <br />the motion. <br />MOTION: Doughty SECONDED: Richardson <br />Mr. Monck indicated that the applicant did not want to construct the residence as <br />suggested by staff. <br />Motion to deny the Appeal of the Planning Manager's Decision No. 2001-02. <br />MOTION: Doughty <br />SECONDED: Richardson <br />Commissioner Verino commented that she supported the motion. She further indicated <br />that several other projects were denied due to the design component and the applicant's <br />unwillingness to modify the plans; and that the Commission had to closely evaluate the <br />projects brought before them and they. had to make the best determination for future <br />uses. <br /> <br />After further discussions, the applicant agreed to meet with staff to try to provide an <br />acceptable plan for the addition. <br />Commissioner Doughty rescinded her motion to deny the request. Commissioner <br />Richardson rescinded his second. <br />Motion to continue the Appeal of the Planning Manager's Decisfon No. 2001-01 to <br />Aprf! 23, 2001. <br />MOTION: Doughty <br />SECONDED: Richardson <br />2 <br />
