SAHA will inform owners of their responsibility to screen prospective tenants, and will provide <br />owners with the required known name and address information, at the time of the turnover HQS <br />inspection or before. SAHA will not provide any additional information to the owner, such as <br />tenancy history, criminal history, etc. <br />Owner Responsibility <br />The owner is responsible for screening and selection of the family to occupy the owner's unit. <br />When screening families the owner may consider a family's background with respect to the <br />following factors: <br />~ Payment of rent and utility bills; <br />~ Caring for a unit and premises; <br />~ Respecting the rights of other residents to the peaceful enjoyment of their housing; <br />~ Drug-related criminal activity or other criminal activity that is a threat to the health, safety, or <br />property of others; and <br />~ Compliance with other essential conditions of tenancy. <br />PART VII: OCCUPANCY <br />17-VILA. OVERVIEW <br />After an applicant has been selected from the waiting list, determined eligible by SAHA, they are <br />referred to an owner and if determined suitable by the owner, and the unit passes HQS <br />inspection, the family will sign the lease and occupancy of the unit will begin. <br />17-VILB. LEASE [24 CFR 983.256] <br />The tenant must have legal capacity to enter a lease under state and local law. Legal capacity <br />means that the tenant is bound by the terms of the lease and may enforce the terms of the lease <br />against the owner. <br />Form of Lease [24 CFR 983.256(b)] <br />The tenant and the owner must enter into a written lease agreement that is signed by both parties. <br />If an owner uses a standard lease form for rental units to unassisted tenants in the locality or <br />premises, the same lease must be used for assisted tenants, except that the lease must include a <br />HUD-required tenancy addendum. The tenancy addendum must include, word-for-word, all <br />provisions required by HUD. <br />If the owner does not use a standard lease form for rental to unassisted tenants, the owner may <br />use another form of lease. <br />SAHA will not review the owner's lease for compliance with state or local law. <br />Lease Requirements [24 CFR 983.256(c)] <br />The lease for a PBV unit must specify all of the following information: <br />~ The names of the owner and the tenant; <br />iii29iio Page 17-21 <br />
