A. BACKGROUND <br />State law establishes time limits for the exercise of basic redevelopment activities. In <br />accordance with CRL Section 33333.6 or redevelopment plans adopted on or before December <br />31, 1993, the following limits shall apply: <br />The time limit to establish loans, advances, and indebtedness to be paid with the revenue from <br />property taxes may not exceed 20 years from the adoption date of the redevelopment plan or <br />January 1, 2004, whichever is later. <br />The effectiveness of a redevelopment plan may not exceed 40 years from the adoption date or <br />January 1, 2009, whichever is later. After the effectiveness of a redevelopment plan has <br />expired, an agency has no authority to act pursuant to the redevelopment plan except to pay <br />previously incurred indebtedness and to enforce existing covenants and contracts. A <br />redevelopment agency may receive property tax increment up to ten years from the <br />termination of the redevelopment project area plan. <br />If provided by the redevelopment plans, an agency may commence eminent domain <br />proceedings to acquire property within the Project Area for a period not to exceed 12 years <br />from the adoption date. <br />If a redevelopment plan adopted prior to October 1, 1976 authorizes the issuance of bonds, the <br />redevelopment plan should include a limit on the amount of bonded indebtedness that can be <br />outstanding at one time.
