Further, staff contacted the Association in early March to <br />provide an update and obtain feedback on the proposed project. Finally, the contacts for this <br />Neighborhood Association were notified by mail 10 days prior to this public hearing. <br />The project site itself was posted with two notices advertising this public hearing, a notice was <br />published in the Orange County Reporter and mailed notices were sent to all property owners <br />within 500 feet of the project site, as well as concerned citizens listed on the Permanent <br />Notification List. At the time of this printing, no correspondence, either written or electronic, had <br />been received from any members of the public. <br />CEQA Analysis <br />In accordance with the California Environmental Quality Act, the recommended actions have been <br />reviewed through an Addendum to the previously certified Environmental Impact Report 2004-02. <br />CEQA guidelines (California Code of Regulations 15000, et seq.) authorizes the use of an <br />addendum for the purpose of making minor or technical changes, as long as these changes do not <br />rise to the level of requiring a subsequent or supplemental EIR pursuant to CEQA Guidelines <br />15162. <br />The originally certified Environmental Impact Report was analyzed in light of the revised site plan <br />and it was determined that there are no new significant impacts resulting from the changed plan. <br />Several mitigation measures that required modification and/or further clarification have been added <br />to the conditions of approval for this project. <br />Additionally, a new traffic study was performed to analyze the potential changes in traffic <br />circulation as a result in the increase in units. The result of the traffic analysis concluded that the <br />residential use at this site will result in 11 more trips in the morning peak hour, 12 more trips in the <br />afternoon peak hour and 139 more trips on a daily basis. However, according to the revised traffic <br />study, the proposed project will not exceed, either individually or cumulatively, a level of service <br />standard established by the County congestion management agency for designated roads or <br />highways. Therefore, no additional review or mitigation measures are needed (Exhibit 8). <br />The determination that there are no new significant impacts or any increases in the severity of the <br />impacts previously identified in the original Environmental Impact Report mean that in accordance <br />with CEQA 15164, the Addendum to the previously certified MacArthur Place South EIR and <br />Mitigation Monitoring and Reporting Program is the appropriate document for the actions proposed <br />(Exhibit 9). <br />75B-10
