entire MacArthur Place South as a viable mixed-use <br />community. <br />iv. Will the proposed use comply with the regulations and <br />conditions specified in Chapter 41 for such use? <br />The project will be in compliance with all applicable <br />provisions of Chapters 34 and 41 of the Santa Ana <br />Municipal Code as well as the provisions of the SD-76 <br />zoning district, except for the tandem parking <br />requirement. A variance, with appropriate justification, <br />has been submitted to deviate from the tandem parking <br />standards. <br />V. Will the proposed use adversely affect the General Plan or any <br />specific plan of the City? <br />The proposed project will not adversely affect the <br />General Plan as multi-family residential development is <br />conditionally permitted within the Specific Development <br />No. 76 (SD-76) zoning district. Further, Policy 1.3 of the <br />General Plan Land Use Element encourages high- <br />density residential development within the City's District <br />Centers, and Policy 1.4 promotes the fostering of a <br />variety of residential land uses in the city. <br />E. Applicant has requested approval of Variance No. 2011-04 to allow tandem <br />parking. <br />Section 41-638.1(d) of the Santa Ana Municipal Code states that <br />tandem parking is permitted only within an office development, while <br />the applicant is requesting approval to allow 262 of the 660 total <br />spaces (40 percent) be tandem parking. <br />2. The City Council determines that the following findings which must be <br />established, pursuant to Santa Ana Municipal Code Section 41-638, <br />in order to grant a variance, have been established: <br />That because of special circumstances applicable to the subject <br />property, including size, shape, topography, location or <br />surroundings, that the strict application of the zoning ordinance <br />is found to deprive the subject property of privileges not <br />otherwise at variance with the intent and purpose of the <br />provisions of this Chapter. <br />Resolution No. 2011- <br />75B-1 87 Page 3 of 15
