V. Will the proposed use adversely affect the General Plan or any specific <br />plan of the City? <br />The proposed project will not adversely affect the General Plan as <br />multi - family residential development is conditionally permitted <br />within the Specific Development No. 76 (SD -76) zoning district. <br />Further, Policy 1.3 of the General Plan Land Use Element <br />encourages high- density residential development within the City's <br />District Centers, and Policy 1.4 promotes the fostering of a variety <br />of residential land uses in the city. <br />E. Applicant has requested approval of Variance No. 2011 -04 to allow tandem parking. <br />1. Section 41- 638.1(d) of the Santa Ana Municipal Code states that tandem <br />parking is permitted only within an office development, while the applicant is <br />requesting approval to allow 262 of the 660 total spaces (40 percent) be <br />tandem parking. <br />2. The City Council determines that the following findings which must be <br />established, pursuant to Santa Ana Municipal Code Section 41 -638, in order to <br />grant a variance, have been established: <br />That because of special circumstances applicable to the subject <br />property, including size, shape, topography, location or surroundings, <br />that the strict application of the zoning ordinance is found to deprive the <br />subject property of privileges not otherwise at variance with the intent <br />and purpose of the provisions of this Chapter. <br />The project site has a special circumstance related to its size, <br />shape and location. The MacArthur Place South site is a <br />contained site surrounded by existing commercial and residential <br />developments. Tandem parking will only be used as assigned <br />parking for the residents. The variance will allow the applicant <br />the ability to use the property in a manner that is consistent with <br />similar surrounding commercial, residential and professional <br />uses. <br />ii. That the granting of a variance is necessary for the preservation and <br />enjoyment of one or more substantial property rights. <br />The granting of the variance is necessary for the preservation <br />and enjoyment of substantial property rights. The granting of the <br />variance to allow tandem parking will preserve the property <br />owner's ability to develop the property with a well- designed multi- <br />family residential project that is consistent with the Specific <br />Development No. 76 (SD -76) zoning district.
