Chapter 2 CEQA Findings <br />Level of <br />Significance after <br />Impact Statement Evidence/Rationale Supporting Findings Mitigation Measures Findings Mitigation <br />PUBLIC SERVICES <br />Impact 4.10-1 Construction <br />of new projects pursuant to <br />the Transit Zoning Code (SD <br />84) would increase the <br />demand for fire protection <br />services, but it would not <br />require the construction of <br />new or physically altered <br />facilities to accommodate the <br />increased demand or <br />maintain acceptable <br />response times. <br />Impact 4.10-2 Operation of <br />the proposed project would <br />increase the demand for <br />police services, thereby <br />requiring additional staffing, <br />although it would not require <br />the construction of new or <br />physically altered facilities or <br />personnel to accommodate <br />the increased demand. <br />Construction of new projects pursuant to <br />the Transit Zoning Code would increase <br />the demand for fire protection services, <br />but it would not require the construction of <br />new or physically altered facilities to <br />accommodate the increased demand or <br />maintain acceptable response times. <br />However, implementation of the MM4.10-1 <br />would ensure that appropriate steps are <br />taken during project design such that all <br />necessary fire safety features would be in <br />place and available to the SAFD during a <br />call for service. Additionally, individual <br />projects would be required to pay Fire <br />Facility Fee per the City's Municipal Code. <br />The direct population increase associated <br />with build out of the proposed project <br />would increase the demand for police <br />services, reducing the existing officer-to- <br />citizen ratio and potentially resulting in the <br />need for additional personnel and possibly <br />equipment. Compliance with applicable <br />regulations and guidelines and <br />implementation of MM4.10-2 and MM4.10- <br />3 would substantially reduce this impact to <br />less than significant levels by requiring <br />safety plan preparation and reserving <br />emergency services frequency. <br />MM4.10-1 Prior to an issuance of a building <br />permit, individual projects in the Transit <br />Zoning Code (SD 84) area shall perform a <br />water supply, fire flow test and fire protection <br />system design analysis to ensure that <br />proposed projects are in accordance to meet <br />standard fire protection design requirements. <br />MM4.10-2 Any development that would <br />exceed two stories in height shall submit site- <br />specific security plans to the SAPID for review <br />prior to issuance of a building permit. <br />MM4.10-3 No developer within the Transit <br />Zoning Code (SD 84) boundaries shall utilize <br />a frequency of 800 MHz, which is reserved for <br />emergency services. <br />Finding 1 <br />The Agency finds that changes or alterations <br />have been required in, or incorporated into, the <br />project which would avoid or substantially <br />lessen the significant environmental effect as <br />identified in the final EIR. <br />Finding 1 <br />The Agency finds that changes or alterations <br />have been required in, or incorporated into, the <br />project which would avoid or substantially <br />lessen the significant environmental effect as <br />identified in the final EIR. <br />Less than <br />significant <br />Less than <br />significant <br />Transit Zoning Code (SD 84) EIR Findings of Fact/Statement of Overriding Considerations 2-39
