perform the necessary landscape or other maintenance and owner or such successors shall pay all <br />costs incurred for such maintenance. <br />3. Grantee hereby covenants and agrees on behalf of itself and its successors and assigns <br />to the Property or any portion thereof or any interest therein that owner, such successors and assigns <br />shall not discriminate upon the basis of race, color, creed, religion, sex, age, marital status, <br />handicap, national origin, or ancestry in the sale, lease, sublease, transfer, use, occupancy, tenure or <br />enjoyment of the Property, or any improvements erected or to be erected thereon, or any part <br />thereof. <br />4. The covenants established in this Grant Deed shall, without regard to technical <br />classification and designation, be binding on Grantee and any successor in interest to the Property or <br />any part thereof for the benefit and in favor of the Grantor; its successors and assigns, and the City. <br />The covenant against discrimination contained in paragraph 3 of this Grant Deed shall remain in <br />effect in perpetuity. All other covenants contained in this Grant Deed shall remain in effect until <br />July 2, 2026. <br />5. The provisions of this Grant Deed shall be enforceable by the Grantor in a civil action <br />for injunction or any other available remedy against Grantee or its successors in interest. The <br />covenants and restrictions contained in this Grant Deed shall not benefit or be enforceable by any <br />person other than the Grantor, Grantee and their respective successors and assigns. <br />6. Neither this Grant Deed nor any breach of this Grant Deed shall defeat or render <br />invalid the lien of any mortgage or deed of trust made in good faith and for value. <br />The rights established in this section are to be interpreted in light of the fact that the Grantor <br />conveyed the Property to the Grantee for development and not for speculation in undeveloped land. <br />The provisions of this section 6 shall survive only until the recordation of a Certificate of <br />Completion as contemplated by Section 317 ofthis Agreement. <br />EXECUTED this day of <br />ATTEST: <br />Patricia E.
