BENDER READY-MIX CONCRETE MANUFACTURING PROJECT <br />Initial Study/Mitigated Negative Declaration <br />Mitigation Measures: No mitigation is required. , <br />C) Have a substantial adverse effect on federally protected wetlands as defined by Section 404 of , <br />the Clean Water Act (including, but not limited to, marsh, vernal pool, coastal, etc.) through <br />direct removal, filling, hydrological interruption, or other means? <br />No Impact Refer to Responses 4.4(a) and 4.4(b) above. The project site has been previously ' <br />disturbed and is void of sensitive plants, wildlife, and habitats (including wetlands). Thus, no impacts <br />would occur in this regard. <br />Mitigation Measures: No mitigation is required. <br />d) Interfere substantially with the movement of any native resident or migratory fish or wildlife , <br />species or with established native resident or migratory wildlife corridors, or impede the use of <br />native wildlife nursery sites? <br />No Impact. The project would not have the capability to interfere with wildlife movement, nor would it <br />impede the use of wildlife nursery sites. The project area has historically been impacted by heavy <br />industrial uses. The proposed project site was fully impacted and developed prior to Bender Ready-Mix <br />assuming operations at the site in 2006. No sensitive biological habitat exists in the project area, and <br />the area does not support the existence of resident or migratory fish or wildlife species. Thus no <br />impacts would occur in this regard. <br />Mitigation Measures: No mitigation is required. <br />e) Conflict with any local policies or ordinances protecting biological resources, such as a tree <br />preservation policy or ordinance? <br />No impact As discussed above in Responses 4.4(a) and 4.4(b), above, the proposed project would <br />not result in impacts to sensitive biological resources. The site is currently being utilized for heavy <br /> <br />industrial purposes. A minimal amount of landscaping exists along the South Santa Fe Street frontage. ' <br />The only policies applicable to the project are from Chapter 33, Article VII, Regulation of the Planting, <br />Maintenance, and Removal of Trees of the City's Municipal Code. The proposed project would be <br />' <br />consistent with the City <br />s Municipal Code in relation to the addition or removal of trees, No impacts <br />would occur in this regard. <br />Mitigation Measures: No mitigation is required. <br />f) Conflict with the provisions of an adopted Habitat Conservation Plan, Natural Community <br />Conservation Plan, or other approved local, regional, orstate habitat conservation plan? ' <br />No Impact According to the U.S. Fish and Wildlife Service's HCP/NCCP Planning Areas in Southern <br />California Map, the proposed project is not located within a Habitat Conservation Plan or Natural <br />' <br />Community Conservation Plan. <br />No other approved local, regional, or state habitat conservation plans <br />apply to the site. Thus, no impacts would occur in this regard. <br />Mitigation Measures: No mitigation is required.
