(9) BENDER READY-MIX CONCRETE MANUFACTURING PROJECT <br />Initial Study/Mitigated Negative Declaration <br /> <br />C) Directly or indirectly destroy a unique paleontological resource or site or unique geologic <br />feature? <br />o ' <br />Less Than Significant Impact., The pr <br />ject site and surrounding area has been completely disturbed <br />by grading and excavation associated with existing development. Paleontological resources are not <br />expected to occur on-site given previous levels of disturbance in the vicinity. Impacts in this regard are <br />not anticipated to be significant. <br />Miti_ation Measures: No mitigation is required. <br />d) Disturb any human remains, including those interred outside of formal cemeteries? <br />Less Than Significant Impact With Mitigation Incorporated. Given the developed and disturbed <br />nature of the project site, no known human remains, including those interred outside of formal <br />cemeteries, are expected to be encountered during earth removal or disturbance activities. <br /> 1 <br />In accordance with Section 7050.5 of the Califomia Health and Safety Code, in the unlikely event <br />human remains are found during construction, the County Coroner shall be notified within 24 hours of <br />the discovery. If the County Coroner determines that the remains are or believed to be Native <br />American, the County Coroner shall notify the Native American Heritage Commission (NAHC) to <br />determine the appropriate Native American representative for consultation on the disposition of the <br />human remains (refer to Mitigation Measure CUL-3). Thus, impacts would be less than significant. <br />Mitigation Measures: <br />CUL-2 In the event human remains are found during construction, no further excavation or <br />disturbance of the site or any nearby area reasonably suspected to overlie adjacent <br />remains shall occur until the County Coroner has determined, within two working days of <br />notification of the discovery, the appropriate treatment and disposition of the human ' <br />remains. If the County Coroner determines that the remains are or believed to be Native <br />American, the County Coroner shall notify the Native American Heritage Commission in <br />Sacramento within 48 hours. In accordance with Section 5097.98 of the California Public <br />Resources Code, the NAHC must immediately notify those persons it believes to be the <br />most likely descended from the deceased Native American. The descendents shall <br />complete their inspection within 48 hours of being granted access to the site.
