ADMINISTRATOR may, in its sole <br /> <br /> 2 discretion, modify the date upon which the organization-wide audits must be <br /> 3 received, upon notice to CONTRACTOR. <br /> I <br /> 4 26. RECORDS, INSPECTIONS AND AUDITS <br /> 5 26.1 Financial Records: <br /> <br /> 6 26. CONTRACTOR shall prepare and maintain accurate and <br /> 7 complete financial records. Financial records shall be retained, by <br /> <br /> 8 CONTRACTOR, for a minimum of five (5) years from the date of final payment <br /> 9 under this Agreement or until all pending COUNTY, State and Federal audits are <br /> <br /> 10 completed, whichever is later. <br /> <br /> 11 26.1.2 CONTRACTOR shall establish and maintain reasonable <br /> 12 accounting, internal control and financial reporting standards in conformity <br /> <br /> 13 with generally accepted accounting principles established by the American <br /> 14 Institute of Certified Public Accountants and to the satisfaction of <br /> <br /> 15 ADMINISTRATOR. <br /> 16 26.2 Participant Records: <br /> <br /> 17 26.2. CONTRACTOR shall prepare and maintain accurate and <br /> 18 complete records of participants served and dates and type of services <br /> <br /> 19 provided under the terms of this Agreement in a form acceptable to <br /> 20 ADMINISTRATOR. <br /> <br /> 21 26.2.2 All participant records related to services provided under <br /> 22 the terms of this Agreement shall be retained by CONTRACTOR for a minimum of <br /> <br /> 23 five (5) years from the date of final payment under this Agreement or until <br /> 24 all pending COUNTY, State, and Federal audits are completed, whichever is <br /> <br /> 25 later. Notwithstanding anything to the contrary, upon termination of this <br /> 26 Agreement, CONTRACTOR shall relinquish control with respect to participant <br /> <br /> 27 records to COUNTY in accordance with Subparagraph 43.2, j <br /> 28 26.2.3 COUNTY may refuse payment for a claim if participant <br /> <br /> <br /> (WAM0811) 27 of 40 (December 22, 2011) <br /> I <br /> 20B-29 <br />
