In the event <br /> <br /> 2 participant records are determined to be incomplete or inaccurate after <br /> 3 payment has been made, COUNTY may treat such payment as an overpayment within <br /> <br /> 4 the provisions of this Agreement. <br /> 5 26.3 Public Records: <br /> <br /> 6 With the exception of participant records or other records <br /> 7 referenced in Paragraph 31, entitled Confidentiality, all records, including <br /> <br /> 8 but not limited to, reports, audits, notices, claims, statements and <br /> 9 correspondence, required by this Agreement may be subject to public <br /> <br /> 10 disclosure. COUNTY will not be liable for any such disclosure. <br /> 11 26.4 Inspections and Audits: <br /> <br /> 12 26.4.1 The U.S. Department of Health and Human Services, <br /> <br /> 13 Comptroller General of the United States, Director of CDSS, State Auditor- <br /> 14 General, ADMINISTRATOR, COUNTY's Auditor-Controller and Internal Audit <br /> <br /> 15 Department, or any of their authorized representatives, shall have access to <br /> 16 any books, documents, papers and records, including medical records, of <br /> <br /> 17 CONTRACTOR which any of them may determine to be pertinent to this Agreement <br /> 18 for the purpose of financial monitoring. Further, all the above mentioned <br /> <br /> 19 persons have the right at all reasonable times to inspect or otherwise <br /> 20 evaluate the work performed or being performed under this Agreement and the <br /> <br /> 21 premises in which it is being performed. <br /> 22 26.4.2 CONTRACTOR shall make available its books and financial <br /> <br /> 23 records within the borders of Orange County within ten (10) days after receipt <br /> 24 of written demand by ADMINISTRATOR. <br /> <br /> 25 26.4.3 In the event CONTRACTOR does not make available its books <br /> 26 and financial records within the borders of Orange County, CONTRACTOR agrees <br /> <br /> 27 to pay all necessary and reasonable expenses incurred by COUNTY, or COUNTY's <br /> 28 designee, necessary to obtain CONTRACTOR's books and financial records. <br /> <br /> <br /> (WAM0811) 28 of 40 (December 22, 2011) <br /> I <br /> 20B-30 <br />
