The total annual <br /> <br /> adjustment, with the applicable cap set forth herein, shall constitute the basis for next <br /> <br /> year's annual adjustment. <br /> <br /> <br /> <br /> G. Expiration of Cap. Notwithstanding any other provision of this <br /> <br /> Agreement, the Board of Directors, by two-thirds vote of all Directors, may adopt a new <br /> <br /> cost calculation methodology and/or a new cap for cash contract Cities, and/or a <br /> <br /> different membership term for all members, pursuant to Article VII., Section 1. B., to be <br /> <br /> operative July 1, of the first year of the next succeeding term. Any such changes must <br /> be adopted by board action no later than July 1, of the last year of the then current term. <br /> <br /> <br /> <br /> H. New Resources To Cash Contract Cities. Notwithstanding the <br /> <br /> foregoing provisions, whenever new resources are committed to a cash contract City, <br /> <br /> the member shall pay the incremental company cost for such resources. The additional <br /> <br /> resources and increased cost shall not be implemented without consent of the member. <br /> <br /> <br /> <br /> 1. John Wayne Airport. Service levels and charges therefore for <br /> <br /> aircraft rescue firefighting services to John Wayne Airport shall be agreed upon by the <br /> Authority and the member having fire service jurisdiction. <br /> <br /> <br /> <br /> J. Termination. Failure by any member to make payments when due <br /> <br /> constitutes grounds for expulsion from the Authority.
