<br />shall provide written notice of its intention to expel such member if payment is not <br /> <br />received within thirty (30) days of the date of such notice. Repeated failure to make <br /> <br />payments when due shall constitute grounds for expulsion and/or imposition of an <br /> <br />Authority-determined late fee. Alternatively, or in addition to the remedies set forth <br /> <br />herein, the Authority may bring legal action to collect unpaid amounts. <br /> <br />4. Equity. Annually after the conclusion of each fiscal year and consideration <br /> <br />of the audited financial statements for that year, and after consideration of the <br /> <br />Authority's financial needs, the Board of Directors in its sole discretion shall determine <br /> <br />whether sufficient unencumbered funds from that fiscal year are available for additional <br /> <br />services or resources to Structural Fire Fund members. In the event the Board <br /> <br />determines that (1) such funds are available, (2) a distribution is warranted, and (3) that <br /> <br />it is appropriate to do so, it shall allocate those funds, or any portion thereof, to a <br /> <br />restricted Structural Fire Fund Entitlement fund, as follows: <br /> <br />A.
