In providing fire services, OCFA hereby is authorized to and may enforce applicable CITY <br />codes and ordinances, collect and retain any and all Fire Prevention or Miscellaneous User fees <br />(excluding paramedic user fees) as determined by OCFA, and file any claims or actions on behalf of CITY <br />to recover and retain amounts for emergency and hazardous materials responses. <br /> <br />2. The OCFA Fire Chief hereby is designated as Fire Chief of CITY. <br /> <br />3. Personnel and equipment routinely assigned to provide services under this Agreement shall <br />be assigned to Battalion 9. The Battalion Chief of Battalion 9 will exercise day-to-day operational <br />responsibility within the CITY. <br /> <br />4. On activation of the CITY's Emergency Operations Center (EOC), the individuals designated <br />by the CITY Manager and the Division Chief shall be detailed to assist in EOC operations and release of <br />local resources may occur only after their evaluation of local conditions. <br /> <br />V. The specified apparatus shall be delivered to the OCFA equipped as currently equipped by the <br />CITY. OCFA will ensure that frontline emergency apparatus assigned within the CITY (including trucks, <br />engines, and paramedic vans) will reflect the City of Santa Ana's seal, in addition to the OCFA's logo, <br />along with wording to indicate that the apparatus is serving the City of Santa Ana. <br /> <br />2. For the specified apparatus, OCFA will lease from the CITY at no cost, the term of such lease <br />shall commence concurrently with this Agreement, and the term of such lease shall terminate upon <br />retirement of the apparatus from OCFA. <br /> <br />828042.3 <br /> <br />Page 3 <br />
