In the event <br />participant records are determined to be incomplete or inaccurate after <br />payment has been made, COUNTY may treat such payment as an overpayment within <br />the provisions of this Agreement. <br />26.3 Public Records: <br />With the exception of participant records or other records <br />referenced in Paragraph 31, entitled Confidentiality, all records, including <br />but not limited to, reports, audits, notices, claims, statements and <br />correspondence, required by this Agreement may be subject to public <br />disclosure. COUNTY will not be liable for any such disclosure. <br />26.4 Inspections and Audits: <br />26.4. The U.S. Department of Health and Human Services, <br />Comptroller General of the United States, Director of CDSS, State Auditor- <br />General, ADMINISTRATOR, COUNTY's Auditor-Controller and Internal Audit <br />Department, or any of their authorized representatives, shall have access to <br />any books, documents, papers and records, including medical records, of <br />CONTRACTOR which any of them may determine to be pertinent to this Agreement <br />for the purpose of financial monitoring. Further, all the above mentioned <br />persons have the right at all reasonable times to inspect or otherwise <br />evaluate the work performed or being performed under this Agreement and the <br />premises in which it is being performed. <br />26.4.2 CONTRACTOR shall make available its books and financial <br />records within the borders of Orange County within ten (10) days after receipt <br />of written demand by ADMINISTRATOR. <br />26.4.3 In the event CONTRACTOR does not make available its books <br />and financial records within the borders of Orange County, CONTRACTOR agrees <br />to pay all necessary and reasonable expenses incurred by COUNTY, or COUNTY's <br />designee, necessary to obtain CONTRACTOR's books and financial records. <br />(WAM0811) <br />28 of 40 <br />(January 9, 2012)
