ARTICLE III <br />3.0 ATTENDANCE, WORK PERIOD, WORK SCHEDULE & WORKDAY <br />3.1 Attendance. Employees covered by this Agreement shall be in attendance at their work <br />location during hours prescribed by the Police Chief or his designee(s) and shall not absent <br />themselves during prescribed hours without approval of the Police Chief or his designee(s). <br />3.2 Definitions. <br />A. Standard Work Period. The Standard Work Period shall consist of a consecutive <br />seven (7) day, 168 hour period. <br />B. Alternative Work Period-207(k Exem t Employs. The Alternative Work Period <br />shall apply to all members of the Association who are peace officers, detention <br />officers or detention supervisors who are exempt from the overtime provisions of the <br />Fair Labor Standards Act (FLSA) pursuant to Section 207(k). The 207(k) <br />employees' Work Period shall consist of a consecutive 28 day, 672 hour time period. <br />In conformance with the FLSA, members who are peace officers, detention officers, <br />or detention supervisors shall not be eligible for FLSA overtime, as defined under the <br />FLSA for employees assigned to the Alternate Work Period until they have worked in <br />excess of 171 hours in the Alternate Work Period. Nothing in this section shall <br />prevent a peace officer, detention officer or detention supervisor from earning <br />overtime and being compensated for overtime based on the overtime provisions of <br />this Agreement as stated in Article VIII of this Agreement. All overtime shall be <br />paid at one and one-half (1 1/2) times the regular rate of pay. <br />C. Work Hours. Work hours are the regularly scheduled hours of work as determined <br />by the Police Chief or his designee. A "day" is defined as any consecutive 24 hour <br />period. <br />D. Work Schedules. At this time, the Police Chief has established the following work <br />schedules. These schedules may be changed by the Police Chief subject to the <br />provisions of the Meyers-Milias-Brown Act. Unless exigent circumstances exist, the <br />Police Chief, or his designee, shall inform the Association prior to the changing of <br />the below designated Work Schedules. <br />1. Standard Work Period Schedules. <br />a. 5/40 Work Schedule. Employees shall work five (5) eight hour <br />workdays per seven (7) consecutive day, 168 hour Standard Work <br />Period. Each workday shall consist of eight (8) hours of work and a <br />30 minute unpaid meal period. <br />b. 4/10 Work Schedule. Employees shall work four (4)10 hour days per <br />seven (7) consecutive day, 168 hour Standard Work Period. Each <br />workday shall consist of 10 hours of work, and either a 30 minute or <br />
