Santora Building Ad Hoc Report <br />July 2, 2012 <br />Page 2 <br />• August 29, 2002 - Rehabilitation Loan Agreement between CRA and Memphis <br />Partnership for $10,000 (Exhibit 2) for restaurant improvements. <br />• September 16, 2002 -First Amendment to Rehabilitation Loan Agreement between <br />CRA and Memphis Partnership (loan dated Oct. 9, 2002) for additional $20,000 for <br />"excess rehabilitation costs" (Exhibit 3). Outside consultant (Willdan) monitored <br />construction and progress payments. <br />• April 27, 2011 -Art use covenant expired. <br />• May 31, 2011 - Request for Full Reconveyance was granted. <br />• Purpose of agreements was achieved; loans fostered artists/restaurant uses and <br />activities in Artist's Village, which continues to thrive today. <br />II. Protections Provided by Historic Designation <br />• Listed on both the National Register of Historic Places and the Local Registry - <br />restricts interior changes (Exhibit 4); <br />• Exterior/fagade easements (1982 - Heritage Orange County); (1986 - Santa Ana <br />Historical Society) (Exhibit 5); <br />• Additional interior easements (2) held by Heritage Orange County; restrictive <br />wording for example: "in no way shall office square footage be expanded by the <br />movement of existing partitions between the common open space areas and the <br />current office areas as set forth in Exhibit B" (which is an architectural rendering of <br />the spaces showing square footage, doorways, etc) (Exhibit 6); <br />• Holder of Easements is the enforcer of restrictions. All easements are recorded <br />against the property and run with the land. <br />III. Building Code Issues <br />The Santora Building is structurally sound. Should a change in the use/occupancy of the building <br />arise, the following building codes apply and structural changes may be required. The City will <br />not issue permits contrary to the historical protections provided by the designations and <br />easements. <br />1. Change of Occupancy: <br />Section 3408.1 of the 2010 CBC states "no change shall be made in the use or occupancy <br />of any building that would place the building in a different division of the same group of <br />occupancies or in a different group of occupancies, unless such building is made to <br />comply with the requirements of this code for such division or group of occupancies." <br />65A-2
