Page 16 of 41 <br />value between the trees lost and the replacement of trees, this <br />difference will be deducted from the Contractor's payment. In all <br />cases, the Director using the latest American Shade Tree <br />Conference guidelines for value determination will determine the <br />value of the trees lost. <br />E. ANNUAL COLOR <br />All areas having existing annual color shall be maintained per Exhibit C - Annual <br />Color Planting and Maintenance Specification. Annual color shall be rotated four <br />times annually per Exhibit C. <br />F. WEEDS. DISEASE AND PEST CONTROL <br />1) Weed Control <br />a. All landscape and hardscape areas within the specified scope of <br />work (including, but not limited to, turf, shrub and ground cover, <br />planters, tree wells, ornamental bark or rock areas, asphalt or <br />concrete areas) shall be kept free of weeds at all times. The <br />complete removal of all weed growth shall be accomplished on a <br />continuing basis. Weeds shall be controlled by hand and approved <br />mechanical or chemical methods. Should weeds two (2) inches or <br />greater not be removed within one (1) week at the request of the <br />Director, the Director will dispatch his own City forces to remove the <br />weeds. The cost for City staff plus the $150.00 call out fee will then <br />be deducted from the Contractor's monthly payment. <br />2) Disease and Pest Control <br />a. The Contractor shall regularly inspect all landscaped areas (turf, <br />trees, shrubs, ground cover, and annual color) for presence of <br />disease or insect or agricultural rodent infestation. The Contractor <br />shall advise the Director within four (4) days when a problem exists <br />and what course of action they intend to take to resolve the <br />problem. Upon approval of the Director, the Contractor shall <br />implement approved control measures, following all federal, state, <br />county, and municipal laws, regulations and ordinances required for <br />the approved work at no extra cost to the City. <br />b. Approved control measures shall be continued until the problem is <br />controlled to the satisfaction of the Director. The Contractor shall <br />utilize all safeguards necessary during disease; insect or rodent <br />control operations to ensure safety of the public and the employees <br />of the Contractor. <br />Any plant material, which dies without the Contractor's Horticulturist <br />diagnosing the plant and implementing efforts to save the plant, will <br />be considered negligence and, therefore, the Contractor shall <br />25A-
