1WX:IIC <br />Provider will instruct an exercise program for older adults at the Southwest Senior Center for the <br />City's leisure class program. <br />A. Classes shall be one hour per day, two days per week, conducted in one -month sessions <br />during the months of January through October. November and December shall be three - <br />week sessions. <br />B. Consultant and City shall mutually agree to the schedule for classes, including the <br />location, days and hours when class will be held and holidays to be observed. <br />C. Consultant shall provide materials, supplies, equipment, records and personnel. <br />Consultant shall be responsible for clean-up of the facilities and materials and shall <br />ensure the safety and effectiveness of instruction. <br />CLASS SIZE <br />1) Each class must have a minimum of 3 students and a maximum of 50. <br />3) In the event the minimum number of enrollees is not realized by the second meeting of the <br />class, the class shall be canceled. Provider will be under no obligation to provide services and <br />the City will have no obligations to pay Provider compensation. <br />CLASS FEES <br />1) Each participant may pay a donation for class, no student will be refused entry to <br />class, except if class meets maximum. <br />2) No refunds will be made to participants. <br />3) Provider shall collect and retain all donations. <br />4) Provider shall receive one - hundred percent (100 %) of the total donations collected <br />each month. <br />5) Provider agrees that City is entitled to audit Provider's records and classes to insure <br />compliance with this Agreement. <br />
