Findings of Fact based on comments received from the City. The Planning Center team will prepare a Statement of <br />Overriding Considerations (SOC) for the preferred alternative, consistent with the requirements of CHQA. The SOC will <br />identify the significant unavoidable adverse impacts of the preferred alternative and will describe the benefits of tite preferred <br />alternative that override or at least balance those significant unavoidable adverse impacts. <br />Deliverable: <br />O Draft Findings of Fact, Statement of Overriding Considerations, and \r[itigation Monitoring Program <br />PUBLIC 1-IEARINGS /CI":QA CERTIFICA`i-ION <br />The Planning Center will coordinate closely with City staff to ensure that the BIR and associated documents delivered to the <br />City are legally defensible and accurate and will serve as useful tools for decision makers when considering the approval of the <br />project. Our scope of work assumes attendance by our director and project manager at the meetings and public hearings <br />listed below. Additional meeting attendance by The Planning Center or attendance by other members of the consultant team <br />will be billed on a time- and - materials basis in accordance with the hourly rates for the personnel involved. <br />Deliverables: <br />e Up to two(2) Planning Conmtission meetings <br />Y tap to two (2) City Council hearings <br />I1RI :PARR' AND FILE THE NOTICE OF DETERMINATION <br />The Planning Center team will prepare a draft Notice of Determination (NOD) for review by flue City. The Planning Center <br />will prepare the final NOD based on comments received from the City. After die City takes action certifying the Final 13111, the <br />NOD will be riled with the Office of Planning and Resources (OPR) and the Orange County Clerk. <br />Deliverable: <br />Notice of Determination <br />MITIGATION MONITORING AND REPORTING PROGRAM (MMRP) <br />Following filing of the NOD, the Final MIARP will be prepared. The MV1RP will include all the avoidance, minimization, and <br />mitigation measures from the Final 1318. The MMRP will include the language of each measure and permit condition, the <br />agency responsible for implementing that measure /condition, the agency responsible for verifying compliance with that <br />measure /condition, the timing of Implementation of the measure and other relevant information. The Draft MMRP will be <br />submitted to the City for review and comment. The Planning Center team will prepare the 'final MIMP based on tine <br />comments received front the City. <br />Deliverable: <br />4.
