The Contractor shall remove trees, shrubs, turf or ground cover, <br />which is damaged or lost due to any cause and provide the City a <br />cost bid to replace the lost plant material unless the plant material <br />was lost due to the Contractor's negligence. If the plant material <br />is lost due to the Contractor's negligence he/she will replace the <br />plant material at his/her cost with the same species and size of the3 <br />existing plant material. The Director will determine the size lost <br />based upon the maturity of the expired existing plant material. <br />G. In order to ensure maximum healthy growth and overall aesthetic <br />appearance of planting in the work area, it may be desirable to <br />replace certain plants. The Director shall determine the necessity <br />or desirability of such plant replacement and request that the <br />Contractor provide a cost bid. <br />d. The Contractor shall replace, at Contractor's own expense, any turf, <br />ground cover, shrubs, or other plant material requiring replacement <br />through negligence resulting from contractor's failure to provide <br />maintenance in accordance with the provisions of this agreement <br />These requirements are not to be construed as requiring the <br />Contractor to replace plant materials due to conditions beyond the <br />Contractor's control as identified in Section lU (A) <br />EXTRAORDINARY MAINTENANCE, but is to be considered strictly <br />as a normal maintenance condition within accepted practice. It is <br />the intention of the City to require a high level of quality in <br />landscape maintenance compatible with standard practice. <br />2) New Construction <br />a• Where new construction or redevelopment may involve a significant <br />part of a work site, the Director may delete a portion of or the entire <br />work site from contractual maintenance during the construction and <br />plant establishment period. The deletion of this portion of work will <br />be reflected as a reduction in the monthly payment to the <br />contractor. The amount of reduction will be based on the <br />percentage of area involved and agreed upon by the City and the <br />Contractor. <br />3) Inspection <br />a. The Director shall inspect the work area to ensure adequacy of <br />maintenance and that methods of performing the work are in <br />compliance with the contract. However, this shall not be construed <br />to relieve the contractor of the duty to provide continuous inspection <br />and maintain name of the work area. The Contractor shall correct <br />discrepancies and deficiencies in the work immediately. <br />26H-36 <br />
