CONTRACTOR shall not claim <br />reimbursement from COUNTY for, or apply sums received from COUNTY <br />with respect to, that portion of its obligations which have been <br />paid by another source of revenue. CONTRACTOR agrees that it <br />shall not use funds received pursuant to this Agreement, either <br />directly or indirectly, as a contribution or compensation for <br />purposes of obtaining Federal, State or COUNTY funds under any <br />Federal, State or COUNTY program without prior written approval <br />of ADMINISTRATOR. <br />18. EQUIPMENT <br />18.1 All items purchased with funds provided under this <br />Agreement or which are furnished to CONTRACTOR by COUNTY which <br />have a single unit cost of at least five thousand dollars <br />($5,000.00), including sales tax, shall be considered Capital <br />Equipment. Title to all items of Capital Equipment purchased <br />vests and will remain in COUNTY as such shall be designated by <br />ADMINISTRATOR. The use of such items of Capital Equipment is <br />limited to the performance of this Agreement. Upon the <br />termination of this Agreement, CONTRACTOR shall immediately <br />return any items of Capital Equipment to COUNTY or its <br />representatives, or dispose of them in accordance with the <br />directions of ADMINISTRATOR. <br />CONTRACTOR further agrees to the following: <br />18.1.1To maintain all items of Capital Equipment in <br />good working order and condition, normal wear and tear excepted. <br />18.1.2To label all items of Capital Equipment, do <br />periodic inventories as required by ADMINISTRATOR and to maintain <br />(WAM0313) <br />24 of 48 <br />25B-26 <br />(April 8, 2013)
