agreement, the appropriate labor organization and employer must provide written <br />concurrence before the program or activity begins. <br />• A WEX participant may not be employed in or assigned to a job if any other individual is <br />on layoff from the same or any substantially equivalent job. <br />• A WEX participant may not be employed in or assigned to a job if the employer has <br />terminated the employment of any regular, unsubsidized employee or otherwise caused an <br />involuntary reduction in its workforce with the intention of filling the vacancy created with <br />the WEX participant. <br />• A WEX participant may not be employed in or assigned to a job if the job is created in a <br />promotional line that infringes in any way on the promotional opportunities of currently <br />employed workers. <br />• Worksite must not be on strike or on a pre- strike status <br />• Worksite must be ADA compliant. <br />• Worksite must allow State or Federal monitors to monitor the site. <br />• No relative by blood, adoption or marriage of the employer may be trained under WEX. <br />III.PROCEDURES <br />A. Program Referrals <br />There are several ways to recruit for the WEX program. A potential participant can either be <br />recruited directly from universal services, be enrolled in a WIA Youth program, or be an existing <br />program participant and be referred to the WEX by a case manager. <br />B. Initial Meeting with Case Manager <br />This initial meeting is designed to allow the two parties to meet and see what assistance the <br />customer is seeking from the WEX program. WEX staff will evaluate whether the customer's <br />goals are something that WEX can assist with. <br />Customer must be registered and meet the eligibility requirements as defined under WIA <br />Intensive Services or WIA Youth eligibility. Furthermore, to receive intensive services, a <br />customer must be determined eligible in accordance with the priority system as applicable. See PB <br />00 -02 for further details. <br />C. Service Design <br />Background: Once it has been determined that applicant is eligible, staff will meet with participant <br />to start WEX unless otherwise noted in grant. WEX staff must enroll customer into the program. <br />MIS forms need to be entered into JTA by this point. <br />EXHIBIT A <br />25D -216 <br />
