WAIVER <br />No delay or omission by either party hereto to exercise any right or <br />power accruing upon any noncompliance or default by the other party with <br />respect to any of the terms of this Agreement shall impair any such right or <br />power or be construed to be a waiver thereof. A waiver by either of the <br />parties hereto of any of the covenants, conditions, or agreements to be <br />performed by the other shall not be construed to be a waiver of any succeeding <br />breach thereof or of any other covenant, condition or agreement herein <br />contained. <br />35. PETTY CASH <br />CONTRACTOR is authorized to establish a petty cash fund in an amount not <br />to exceed two hundred and fifty dollars ($250.00). <br />36. PUBLICITY <br />36.1 Information and solicitations, prepared and released by <br />CONTRACTOR, concerning the services provided under this Agreement shall state <br />that the program, wholly or in part, is funded through COUNTY, State and <br />Federal government funds. <br />36.2 CONTRACTOR shall not disclose any details in connection with this <br />Agreement to any person or entity except as may be otherwise provided <br />hereunder or required by law. However, in recognizing CONTRACTOR's need to <br />identify its services and related clients to sustain itself, COUNTY shall not <br />inhibit CONTRACTOR from publishing its role under this Agreement within the <br />following conditions: <br />36.2.1 CONTRACTOR shall develop all publicity material in a <br />professional manner: and <br />36.2.2 During the term of this Agreement, CONTRACTOR shall not, <br />and shall not authorize another to, publish or disseminate any commercial <br />advertisements, press releases, feature articles, or other materials using the <br />(WAM0313) <br />34 of 40 <br />(April 8, 2013)
