In the event that all of the conditions of approval have not been met, the <br />City Manager, or designee, may deny the permit applied for, and shall forthwith notify the <br />applicant of the action along with a statement identifying the reasons for the denial. <br />(e) No person, firm, partnership, corporation, company, or non-profit or <br />charitable organization shall conduct any entertainment, without first making application for <br />and obtaining a permit to do so, nor shall any person conduct the same during the time <br />while a permit to do so is revoked. <br />(f) Any modifications or revisions to the live entertainment provided <br />under an entertainment permit require City Manager, or designee, approval. <br />(g) An entertainment permit shall be valid for a period not to exceed one <br />(1) year from date of issuance. Entertainment permits are not automatically renewed and <br />it shall be the responsibility of the permit holder to file a new application for an <br />entertainment permit at least forty-five (45) days prior to the previous permit's expiration. <br />(h) All establishments within the City that were conducting activities <br />requiring permitting and regulated under this section whose activities existed prior to <br />[Ordinance Adoption Date], shall have a period of one (1) year from the date of the <br />adoption of the revisions to apply for an entertainment permit. During such time any fees <br />for the processing of the permit shall be waived. <br />(i) Any permit issued pursuant to the terms of this chapter is issued <br />solely to the person or entity applying for the permit and is non-transferrable to any other <br />person or entity. <br />0) Any permit applicant aggrieved by the decision of the City Manager, <br />or designee, to deny said permit may appeal as provided in Chapter 3 of the Santa Ana <br />Municipal Code, except that the written notice of appeal must be filed with the clerk of the <br />council and the City Manager, or designee, within ten (10) days of service of the written <br />notice of the City Manager's, or designee's, decision. <br />Section 6.
