CUP Nos. 2013-15, 2013-16 & 2013-17 <br />August 26, 2013 <br />Page 4 <br />• The proposed alcoholic beverage license will not be detrimental to persons residing or working in <br />the vicinity but will provide a beneficial service that will help the Downtown area become a <br />destination point. Conditions have been placed on the alcoholic beverage control license which will <br />mitigate any potential impacts created by the use and ensure that the use will not negatively affect <br />the surrounding community. <br />• The proposed alcoholic beverage control license for a restaurant at this location will not be <br />detrimental to persons residing or working in the vicinity because conditions have been placed on <br />the alcoholic beverage control license that will mitigate any potential negative or adverse impacts <br />created by the use. Additionally, the use will serve both visitors and the local and regional business <br />community. <br />• The proposed use will not adversely affect the economic stability of the area, but will instead allow <br />local businesses and the downtown area to become a destination area. Moreover, the offering of <br />various food offerings allows the Downtown to remain economically viable and contributes to the <br />overall success of Downtown Santa Ana, helping to decrease the number of vacant tenant spaces <br />that may affect the economic viability of the site. <br />• As conditioned, the proposed project will be in compliance with all applicable regulations and <br />conditions imposed on a restaurant selling beer and wine pursuant to Chapter 41 of the Santa Ana <br />Municipal Code. <br />• The proposed use will not adversely affect the General Plan. Policy 2.2 of the Land Use <br />Element encourages land uses that accommodate the City's needs for goods and services. A <br />variety of restaurants in Downtown Santa Ana contributes to the economic success of the City as <br />a shopping and dining destination and will provide an additional dining service to the residents of <br />Santa Ana. <br />Conditional Use Permit No. 2013-16 to allow after-hour operations <br />Santa Ana Municipal Code (SAMC) Section 41-2007 (Table 2A) requires a conditional use permit for <br />any eating establishment with hours of operation between 12:00 a.m. and 7:00 a.m. The proposed <br />hours of operation are 11:00 a.m. to 1:00 a.m. Sunday through Thursday, and 11:00 a.m. to 2:00 <br />a.m. on Friday and Saturday which is consistent with the operating hours of the other downtown <br />restaurants. The Native Son Alehouse proposes to be open for lunch and dinner. There are no <br />sensitive land uses that will be adversely impacted from the extended hours of operation. Uses <br />such as residential properties and schools are not located within 150 feet of this lot. Further, <br />conditions of approval will prohibit the use of exterior amplified music and outdoor patio lighting from <br />being directed towards other properties or the right-of-way. <br />31 B-6
