SECOND SIDE LETTER AMENDMENT TO THE <br />CONSOLIDATED MEMORANDUM OF UNDERSTANDING <br />BETWEEN THE CITY OF SANTA ANA AND <br />THE SANTA ANA POLICE OFFICERS ASSOCIATION <br />FOR FISCAL YEARS 2011-13 <br />The following provisions of the parties' MOU are amended as set forth below: <br />Article XIV - Release Time for Association Representative <br />Section 14.1 <br />The Association shall reimburse the City for one hundred percent (100%) of salary (including any salary additives, such as <br />career incentive pay) and benefit costs. Such reimbursement may be from the bank established pursuant to Section <br />8.14 of Article VIII of this Agreement. Effective July 1, 2012, the parties agree as follows: <br />A) The PDA President will be compensated at a rate consistent with his or her departmental rank including all - <br />assignment pay, pay additives, and premiums In place at the time he or she assumes the position of PDA <br />President. <br />B) The value of the President's pay will include base salary, pension, premiums, and medical only. <br />C) The value of the Floating Holiday donations will Include base salary, pension, premiums, and medicare. <br />D) The balance in the Floating Holiday bank as of August 1, 2012 has been agreed upon by the parties as <br />$121,116.24. <br />E) Effective July 1, 2012, the City shall pay the POA President a "Confidential Premium," in lieu of 20 hours per <br />pay period at time and one-half. This premium is contained in the California Public Employees' Retirement <br />Law (PERL) and is described as "compensation to rank and file employees who are routinely and consistently <br />assigned to sensitive positions requiring trust and discretion." The parties agree that the value of this <br />premium shall be equivalent to 28 hours of pay at straight time per pay period. The rate paid shall be tied to <br />the Incumbents rank. The POA agrees that the acceptance of said compensation as described in section E as <br />"PERSable" is subject to PERS approval and if It is determined that said compensation Is not "PERSable" the <br />City is not obligated to provide additional benefits. <br />F) Total annual salary and benefits for the current POA President for FY 2012-13 are projected at approximately <br />$204,488.64, assuming 28 hours per pay period at straight time for President's pay. Total projected value of <br />Floating Holiday donations for 2012 is $196,904.21. This does not include additional Union time usage by <br />Board members. <br />G) PDA agrees to reduce the number of board meetings from two to one per month and require their members <br />who are on duty to attend during lunch. For those not on duty (graveyard), time spent will be considered <br />"voluntary" in nature. This will reduce significantly the amount of additional Union time being deducted from <br />the Floating Holiday bank. <br />H) The Police Chief shall approve days off for five board members, twice per year, to attend the Peace Officers' <br />Memorial and FOP, respectively.
