AA No. 2013 -04, TTM No. 2013 -05, <br />& SPR No. 2013 -04 <br />November 4, 2013 <br />Page 2 <br />HOUSING OPPORTUNITY ORDINANCE <br />This project is subject to the City's Housing Opportunity Ordinance (HOO) pursuant to SAMC 41- <br />1900 et seq. The HOO applies to any residential project where a zone change to allow residential <br />uses, or approval of an overlay zone for residential uses is proposed. The ordinance requires that <br />the project include units affordable to households qualifying under the County's income <br />classifications for Very Low to Moderate incomes. In the case of this project, the applicant must <br />provide 5 for -sale units (15 percent of 28 total units) meeting the affordability guidelines for <br />Moderate income. Prior to issuance of building permits, the applicant is required to submit both an <br />Inclusionary Housing Plan and Inclusionary Housing Agreement to be approved ministerially <br />detailing the manner in which the program will be administered. These documents are subject to <br />the review and approval of the City Attorney's Office, the Planning Division and the Community <br />Development Agency. The Inclusionary Housing Agreement will also be recorded against the <br />property. In addition, a condition of approval will be placed on the Tentative Tract Map that states <br />the Inclusionary Housing Plan and Inclusionary Housing Agreement shall comply with the <br />procedures for establishing eligibility and applicant priority contained within the Housing Element <br />as it may be adopted and amended by the City Council. At a minimum these eligibility criteria shall <br />give priority to tenants /buyers whose household income is on the lower end of the applicable <br />income range and tenants /buyers who are residents of Santa Ana. The provisions of the <br />Inclusionary Housing Plan must be fully implemented prior to any issuance of Certificate of <br />Occupancy. <br />FISCAL IMPACT <br />There is no fiscal impact associated with this action <br />Jay .
