Covenants, Conditions and Restrictions <br />(CC &Rs) are required for the project, which need to be approved by the City prior to the <br />recordation of the final map. <br />• The proposed site consists of approximately five acres of land within the Metro East Mixed Use <br />Overlay Zone, which is physically suitable for the residential development as proposed. Access <br />to the site will occur on First Street and Cabrillo Park Drive. There are no physical constraints <br />on the site to preclude development, <br />• An Environmental Impact Report (EIR), as well as an addendum to the certified EIR, was <br />prepared pursuant to the California Environment Quality Act for the project. The project site is <br />located in an urbanized area, and there are no known fish or wildlife populations existing on the <br />project site. Therefore, the proposed subdivision will not cause any substantial environmental <br />damage or substantially and avoidably injure fish and wildlife or their habitat. <br />• The proposed subdivision will not have any detrimental effects upon the general public. The <br />short -term and long -term unavoidable adverse impacts identified in Environmental Impact <br />Report No. 2006 -01, and affirmed by the recently completed addendum to the EIR, as it <br />pertains to air quality and traffic, were addressed by the adoption of a statement of Overriding <br />Considerations by the City Council, Any other negative or adverse impacts will be mitigated <br />through mitigation measures identified in Environmental Impact Report No. 2006 -01. <br />• There is no easement for public access currently existing on this property. Therefore, the <br />proposed project will not conflict with easements necessary for public access through or use of <br />the property. However, the applicant will be granting an easement for pedestrian purposes <br />over the northern portion of the site, which will allow public access throughout the Metro East <br />area. <br />Site Plan Review <br />The applicant is requesting site plan approval for the project. Pursuant to Section 2 of the Metro <br />East Mixed Use Overlay Zone document, the Planning Commission is required to review and <br />approve all plans for development within the Metro East area to ensure the project is in conformity <br />with the MEMU Overlay Zone standards. The review ensures that the buildings, structures and <br />grounds are in keeping with the neighborhood and will not be detrimental to the development of the <br />MEMU area. <br />The Metro East Mixed -Use Overlay Zone (MEMU) design and development standards are <br />intended to create a unique urban environment by allowing for the introduction of well - designed <br />mixed -use projects into the existing primarily office environment.
