Ordinance Second Reading, <br />VTTM No. 2013 -04 & SPR No. 2013 -03 <br />November 18, 2013 <br />Page 2 <br />The Lyon Community project at 1901 East First Street will be a new 254 -unit multi - family <br />residential project in a contemporary architectural style featuring a wide variety of unit types, an <br />extensive amenity package, a retail component, and the provision of both private and publicly - <br />accessible open space. Parking for the project will be provided within an existing parking <br />structure. The project site is located within the Metro East Mixed Use Overlay Zone and was <br />previously entitled as the First and Cabrillo Towers, for which environmental impacts reports were <br />previously prepared. Additional environmental analysis was performed for the proposed project in <br />the form of an addendum to the previously - certified EIRs. This addendum did not identify any <br />additional environmental impacts. The requested actions would approve the addendum to the EIR, <br />modify the existing development agreement to reflect the proposed project, approve a vesting <br />tentative tract map that would allow for the potential for future condominium sales of the units, and <br />approve the site plan for the project. Additionally, after the Planning Commission hearing, a <br />condition of approval has been recommended by staff to be added to the entitlements that require <br />the construction of a block wall and decorative wrought iron fence along the east property line of <br />the site, in line with an agreement reached between property owners. <br />Additionally, at the recommendation of the Council Ad Hoc Committee, and as agreed to by the <br />applicant, the Council approved modifications to the development agreement to incorporate 10 <br />affordable units into the project and to allow the addition of 10 more units to the project, resulting in <br />a total of 264 units. <br />VESTING TENTATIVE TRACT MAP NO. 2013 -04 AND SITE PLAN REVIEW NO. 2013 -03 <br />On August 26, 2013, the Planning Commission recommended that the City Council adopt a <br />resolution approving both Vesting Tentative Tract Map No. 2013 -04 and Site Plan Review No. <br />2013 -03. Although the project will initially be a rental project, approval of the vesting tentative tract <br />map will allow the applicant the ability to sell the units in the future as economic conditions warrant. <br />The site plan review approval is a determination that the project is consistent with the provisions of <br />the Metro East Mixed Use (MEMU) Overlay Zoning Code. However, since changes needed to be <br />made to the project to incorporate the 10 affordable housing units recommended by the Council Ad <br />Hoc Committee, the Council was unable to act on these two applications at their October 21, 2013 <br />Council meeting. The applicant has since revised the plans to reflect two significant changes: The <br />incorporation of 10 affordable units into the project; and the addition of 10 more units into the <br />development, resulting in a total unit count of 264. The attached plans reflect the changes made to <br />the project per the City Council's approval of Amendment to Development Agreement No. 2007 -01 <br />on October 21, 2013 (Exhibit B). <br />75A -2 <br />
