Ordinance Second Reading, <br />VTTM No. 2013 -04 & SPR No. 2013 -03 <br />November 18, 2013 <br />Page 3 <br />HOUSING OPPORTUNITY ORDINANCE <br />Although not originally subject to the Housing Opportunity Ordinance (HOO) the First Amendment <br />to the Development Agreement included the requirement to comply with SAMC 41 -1900 et seq. In <br />the case of this project, the applicant must provide 10 rental units meeting the affordability <br />guidelines for Low income pursuant to the amendment to the project's Development <br />Agreement. Prior to issuance of building permits, the applicant is required to submit both an <br />Inclusionary Housing Plan and Inclusionary Housing Agreement to be approved ministerially <br />detailing the manner in which the program will be administered. These documents are subject to <br />the review and approval of the City Attorney's Office, the Planning Division and the Community <br />Development Agency. The Inclusionary Housing Agreement will also be recorded against the <br />property. In addition, a condition of approval will be placed on the Vesting Tentative Tract Map <br />that states the Inclusionary Housing Plan and Inclusionary Housing Agreement shall comply with <br />the procedures for establishing eligibility arid. applicant priority contained within the Housing <br />Element as it may be adopted and amended by the City Council. At a minimum these eligibility <br />criteria shall give priority to residents whose household income is on the lower end of the Low <br />income range and residents who are residents of Santa Ana. The provisions of the Inclusionary <br />Housing Plan must be fully implemented prior-to any issuance of Certificate of Occupancy. <br />FISCAL IMPACT <br />There is no fiscal impact associated with this action <br />Ja M.
