ZONING ADMINISTRATOR HEARING <br />MINUTES <br />JUNE 17, 2009 <br />CONDITIONAL USE PERMIT NO. 2009 -14 <br />10:59 a.m. <br />Mr. Sergio Klotz, Zoning Administrator, called to order the public hearing in the City Hall <br />Ross Annex Conference Room 2001. <br />Also in attendance were: Joe Takeda and Mira Pak, Applicants; Anna Lauri, Red <br />Mountain; Matt Foulkes, Assistant Planner I; Mike McCoy, Yolanda Pena and Monica <br />Hernandez, Police Department; and Jocelyn Magalona, Recording Secretary. <br />Matt Foulkes presented the staff report and recommendation. <br />There were no written communications. <br />Ms. Pena noted that the Alcoholic Beverage Control (ABC) analysis on Exhibit 5 of the <br />staff report did not come from the Police Department. Mr. Foulkes stated it was <br />obtained from the ABC website. <br />Mr. McCoy stated the Police Department's reluctance to approve an additional <br />discretionary action at the site due to a lack of compliance with existing conditions. The <br />two conditions involved are the requirement of a security guard in the rear parking lot as <br />well as bringing the lighting standards up to code. <br />Discussion and clarification ensued regarding the security guard and lighting standards. <br />Ms. Hernandez stated she will be sending a letter to Chipotle and a copy to Red <br />Mountain in reference to the non - compliance. <br />Mr. Foulkes also indicated that a signage placard to be placed in the rear parking lot as <br />part of Chipotle's condition of approval is not in place. <br />Ms. Lauri stated the property management will ensure the issues raised will be complied <br />with. <br />Mr. McCoy stated the Police Department needs to see the applicant's contract for the <br />guard company being used and the hours the guard will be on duty. He also indicated <br />that the lighting standards must be up to code prior to the issuance of a Letter of <br />Approval to the ABC Board. Mr. McCoy noted that the conditions of approval are the <br />applicant's responsibility. <br />Conditional Use Permit No. 2009 -14 <br />Page 1 of 2 <br />
