N- 2013 -128 <br />Amendment No.2 to <br />Agreement No. D07 -028 <br />AMENDMENT NO.2 TO AGREEMENT NO, D07 -028 <br />1 <br />2 THIS AMENDMENT NO.2 to Agreement No. D07 -028, for purposes of identification hereby dated the <br />3 day of OJOLl-is <br />4 BY AND BETWEEN <br />5 COUNTY OF ORANGE <br />6 a political subdivision of the State of California, hereinafter <br />7 referred to as "COUNTY ", <br />8 AND <br />9 CITY OF SANTA ANA <br />10 A municipal corporation organized and existing pursuant to the <br />11 Constitution and Laws of the State of California <br />12 RECITALS <br />13 WHEREAS, COUNTY and the Cities of Anaheim, Los Alamitos, and Seal Beach collectively referred to <br />14 herein as "CITIES ", entered into Agreement No. D07 -028, hereinafter referred to as "AGREEMENT," for the <br />15 provision by the Orange County Surveyor of City Map Checking Services to CITIES for a term of twenty (20) years, <br />16 a copy of which is attached as Exhibit "A" and incorporated herein by reference, and hereinafter referred to as <br />17 "AGREEMENT'; <br />18 WHEREAS, Section 13 of AGREEMENT provides that other cities located within the geographical <br />19 boundaries of Orange County shall be permitted to become parties to AGREEMENT as it may be amended from <br />20 time to time at the sole discretion of COUNTY and upon the written approval of COUNTY without the necessity of <br />21 COUNTY obtaining the approval of CITIES; <br />22 WHEREAS, Section 13 of AGREEMENT provides, that such additional cities shall have the same rights <br />23 and obligations of the original party CITIES just as though the additional cities were original signatories to <br />24 AGREEMENT; <br />25 WHEREAS, Section 13 of AGREEMENT provides that COUNTY may delegate the authority to add <br />26 additional cities as parties to AGREEMENT to COUNTY's Director of OC Public Works or his designee, hereinafte <br />1 of 6 <br />
