CITY OF SANTA ANA <br />SPECIFICATION FOR PROVIDING PARK LANDSCAPE MAINTENANCE SERVICES IN DISTRICT 4 <br />INTRODUCTION <br />The City of Santa Ana is issued a Request for Proposals (RFP) for providing park landscape <br />services in District 4 for 16 parks and other properties listed in Exhibit C. The detailed specification <br />which includes Exhibit A describes the quality of work that is expected from the contractor. <br />II. PERIOD OF CONTRACT <br />Unless earlier terminated as allowed for in the agreement, contract term shall be for a period of 18 <br />months with four one -year options. The contract term is anticipated to commence after City <br />Council award of this contract and upon receipt and approval of all required bonds and insurance <br />documents. The projected contract award date is July 15, 2013 and may be adjusted as <br />necessary. <br />III. OPTION OF RENEWAL <br />The term of this agreement may include provision for renewals as set forth in the Scope of Services, <br />attached as Exhibit A. <br />IV. FISCAL NONFUNDING CLAUSE <br />In the event sufficient budgeted funds are not available for a new fiscal period, the City shall retain <br />the right to notify the provider of such occurrence in writing at least thirty (30) days before the end of <br />the current fiscal period and terminate the contract on the last day of the current fiscal period <br />without penalty or expense to the City. <br />V. PROPOSAL DEPOSIT AND PERFORMANCE BOND <br />A proposal deposit in the amount of five percent (5 %) of the total proposed annual contract <br />amount set forth in Exhibit C accompanied each proposal. The proposal deposit was in the form <br />of a bid bond, cashier's check, certified check, bank draft, letter of credit, trust company treasurer's <br />check, or money order. Checks shall be payable to the City of Santa Ana. NO PERSONAL OR <br />COMPANY CHECKS WERE ACCEPTED. Proposal deposit of the unsuccessful proposers were <br />returned upon award of contract by the City. <br />The successful proposer shall supply a payment bond in the amount of fifty percent (50 %) of the <br />successfully awarded total annual contract amount of the proposal prior to execution of the <br />contract. Upon receipt of the payment bond, the proposal deposit will be returned. The proposal <br />deposit is subject to be forfeited if the successful proposer fails to execute the written contract and <br />furnish the required payment bond, or to satisfy any other conditions present within a reasonable <br />time as determined by the City. The payment bond is to be renewed annually and submitted by the <br />contractor in the amount of 50% of the annual contract amount. <br />District 4 Park I_andacana Rnanifinatinn <br />
