ARTICLE XIV <br />14.0 RELEASE TIME FOR ASSOCIATION REPRESENTATIVE <br />During the term of this Agreement, the City agrees to grant full -time release from duty for one (1) <br />Association representative for the conduct of Association affairs subject to the following: <br />14.1 The Association shall reimburse the City for one hundred percent (100 %) of salary <br />(including any salary additives, such as career incentive pay) and benefit costs. Such <br />reimbursement may be from the bank established pursuant to Section 8.15 of Article VIII <br />of this Agreement. Effective July 1, 2012, the parties agree as follows: <br />A. The POA President will be compensated at a rate consistent with his or her <br />departmental rank including all assignment pay, pay additives, and premiums in <br />place at the time he or she assumes the position of POA President. <br />B. The value of the President's pay will include base salary, pension, premiums, and <br />medical only. <br />C. The value of the Floating Holiday donations will include base salary, pension, <br />premiums, and Medicare. <br />D, Effective July 1, 2012, the City shall pay the POA President a "Confidential <br />Premium" in lieu of 20 hours per pay period at time and one -half. This premium <br />is contained in the California Public Employees' Retirement Law (PERL) and is <br />described as "compensation to rank and file employees who are routinely and <br />consistently assigned to sensitive positions requiring trust and discretion." The <br />parties agree that the value of this premium shall be equivalent to 28 hours of pay <br />at straight time per pay period. The rate paid shall be tied to the incumbent's <br />rank. The POA agrees that the acceptance of said compensation as described in <br />section E as "PERSable" is subject to PERS approval and if it is determined that <br />said compensation is not "PERSable" the City is not obligated to provide <br />additional benefits. <br />E. The Police Chief shall allow on -duty time, (up to three days) for five board <br />members, once per year, to attend the Peace Officers' Memorial. The Police Chief <br />shall allow on -duty time (up to four days) for five board members, once per year, <br />to attend the FOP.. POA will pay for all costs for the board members attendance <br />at said events, including per diem, travel, hotel, etc. If the Memorial or FOP falls <br />on a board members normal day off, they will not receive on -duty pay for <br />attendance. <br />14.2 The Association shall provide an insurance policy or policies, or certificate of such <br />insurance, naming the City of Santa Ana, its officers, employees and agents as insured or <br />additional insured, which provides coverage against liability for any and all claims and /or <br />M <br />25B -58 <br />
