suits for damages or injuries to persons or property resulting from or arising out of any <br />act or omission of said Association representative. Said policy or policies of insurance <br />shall provide coverage for both bodily injury and property damage in not less than the <br />following minimum amounts: One million dollars ($1,000,000.00) combined single limit <br />or its equivalent. Said policy or policies shall also contain a provision that no termination, <br />cancellation or change of coverage of insured or additional insured shall be effective until <br />thirty (30) days' notice thereof has been given in writing to the City of Santa Ana. <br />14.3 The Association shall provide the City of Santa Ana with an insurance certificate from a <br />workers' compensation insurance carrier certifying that it carries primary workers' <br />compensation insurance on behalf of said Association representative and the policy shall <br />not be cancelled nor the coverage reduced except upon ten (10) days' prior notice to the <br />City of Santa Ana. <br />14.4 The Association shall indemnify and save harmless the City of Santa Ana, its officers and <br />employees, from and against any and all damage to property or injuries to or death of any <br />person or persons, including property and employees or agents of the City of Santa Ana, <br />and shall defend, indemnify and save harmless the City of Santa Ana, its officers and <br />employees, from any and all claims, demands, suits, actions or proceedings of any kind or <br />nature, including, but not by way of limitation, workers' compensation claims, resulting <br />from or arising out of the negligent acts, errors, or omissions, or arising out of the <br />intentional or malicious acts of Association's representative. <br />14.5 The Association and the City of Santa Ana agree that the Association's representative will <br />not be required to carry out any peace officer's duties during such time that the <br />Association's representative is on such full -time release from duty. The Association's <br />representative will be required to comply with the Rules and Regulations of the Santa <br />Ana Police Department as they apply to off -duty employees, except such representative <br />will not be required to report for duty for any purpose. <br />14.6 Upon return to duty from such full -time release, the Association's representative shall be <br />restored to the same position without loss of any benefits as he or she would have <br />occupied or accrued if there had been no disruption in duty status. <br />The Association agrees that since the Association representative does not report for duty <br />or account to the City for his or her sick leave or vacation time, that vacation and sick <br />leave accruals shall be treated as follows: <br />A. The Association representative shall accrue eight (8) hours of sick leave each <br />month until the accrued sick leave total reaches a maximum of 1600 hours. <br />B. Vacation shall be accrued consistent with existing POA MOU provisions. The <br />Association representative may not carry over from one (1) calendar year to the <br />next more than the equivalent of one (1) longevity vacation period and the <br />equivalent of one (1) regular vacation period from the previous two (2) years. <br />57 <br />25B -59 <br />
