apply to the activities of officers, agents or employees of any of the Participating Agencies when <br />performing their respective functions for that agency, shall apply to them to the same degree and extent <br />while engaged in the performance of any activity, function or duty pursuant to this Agreement, subject to <br />the provisions of Sections 5.1 and Chapter 7 of this Agreement. <br />4. <br />HAZARDOUS MATERIALS RESPONSE SERVICES <br />4.1 Basic Services <br />The Authority, through the Provider Agencies, shall furnish all Participating <br />Agencies with Hazardous Materials Emergency response services subject to the following: <br />A. Services will be performed by Provider Agency personnel. The Board, <br />in cooperation with the Provider Agencies, shall determine the number, location and size of the Response <br />Teams available to provide services pursuant to this Agreement. <br />B. The Provider Agencies and their Response Teams will generally provide <br />services in accordance with the provisions of the current Hazardous Materials Emergency Response Plan, <br />The Board shall adopt criteria and standards relating to the provision of Hazardous Materials Emergency <br />response services by Provider Agencies and Response Teams. Such standards may include specific levels <br />of training required of personnel, manpower needs and the type of equipment and supplies necessary for <br />particular Hazardous Materials emergencies, The Board shall also adopt response zones and response <br />procedures to control which Provider Agency should respond to any specific Hazardous Materials <br />Emergency. The Authority, Provider Agencies and Response Teams retain sole and exclusive discretion <br />as to the specific type, nature and timing of the services performed pursuant to this Agreement, provided, <br />however, each Provider Agency shall be subject to the provisions of Subsection 5.4 (D). Neither the <br />Authority, Provider Agencies nor Response Teams are responsible for the physical containment or clean <br />-14- <br />
