Several of our clients have expressed an interest in having greater protective <br />measures in mitigating risks they perceive are unique in using temporary staff in <br />public agencies. This risk comes from how cities utilizes the temporary staff in <br />conjunction with how the contracting firm operates, manages and documents the <br />management of its employees. Recent California court cases have centered on <br />co- employment relationships with temporary contract staff in public organizations <br />and resulting judgments highlight the importance of proper employee <br />management. <br />Project Partners specializes in providing contract staff to public sector agencies. <br />Though our decade long practice, we have developed a very thorough and in- <br />depth understanding of California Labor law specifically as it applies to <br />contingent staff in public organizations. Equally and perhaps more important, we <br />have worked with the region's prominent legal firms with expertise in this issue. <br />Together we developed an operational model and accompanying policies and <br />procedures that properly handle contingent staff and allow their safe use in public <br />organizations. This operational model legally identifies and documents who is the <br />legal employer of the contract staff, eliminating the co- employment issue, and <br />allowing the public agencies to safely receive the benefits of contract staff. <br />Implementation of this operational model provides dramatically greater protection <br />for public sector organizations, but also increases the cost our operations. Thus <br />Sheet # 2 presents the higher Mark -Up Percentages that are required to <br />implement our Operational Model, <br />1.3 Approach <br />Project Partners has three goals in providing supplemental staff to the City of <br />Santa Ana. With each goal we outline our approach and the benefits achieved <br />by that approach. <br />The Goals and Approaches are: <br />• Safe and Effective use of Contingent Contract Staff — As <br />mentioned in the section above, Project Partners will give the City the <br />ability to minimize risks associated with utilization of contingent staff. <br />Provide Flexibility of Staff Resources to Maximize Efficiency- <br />Flexibility is one of the key benefits of having temporary staff in an <br />organization and often the main reason municipal agencies use <br />Project Partners. Use of our temporary staff allows Garden Grove's <br />Public Works Department to adjust both manpower as well as specific <br />expertise to match the variable needs of the organization. <br />Since Project Partners is an engineering staffing firm, we also have a <br />large array of other public works disciplines.
