Based on a review of the proposed pipeline Improvements and existing setting, It is anticipated that a CEQA Statutory Exemption Will apply to the project. While It is acknowledged that the City's RFP Identifies a Negative Declaration, the use of a Statutory Exemption appears highly appropriate for the project and would result In substantial time and cost benefits to the City. As such, RBF will prepare two (2) separate Notices of Exemption (one for each pipeline project). Each Notice of Exemption (NOE) will cite the CEQA Statutes, Section 21080.21, Application of Division to Public Right -of -Way Pipeline Projects Less Than One Mile in Length. This Statutory Exemption applies to the construction, maintenance, repair, restoration, reconditioning, relocation, replacement, removal, or demolition of pipeline located entirely within public right -of -way, and less than one mile in length. Each NOE will provide a brief project description, a description of the project site and affected area, and substantiation for the exemption. The NOE will be filed with the County Clerk and State Clearinghouse upon approval by the City. This task specifically excludes the preparation of an Initial Study, Negative Declaration, or Environmental Impact Report. If it Is determined by the City that an alternate form of CEC1A documentation is required, a separate scope and'fee can be provided. 25C -98
