CITY RESPONSE TO COALITION'S LIST OF CONCERNS DATED 4 -21 -14 <br />1. Two 2) week extension for item placement on City Council agenda on May 20, 2014. <br />The item has been continued until July 1, 2014. City staff has met with Coalition's <br />representatives to discuss their options and proposed site plan since the end of April. <br />Appraisals for all Coalition properties have been updated. City Attorney is coordinating with <br />Coalition's Attorney in regards to compensation to the Coalition. <br />2. City to submit legally binding offer by April 25, 2014 with a minimum ten (10) <br />business day period for consideration by business owners. <br />Offers were prepared for each property and were submitted to each owner in October 2013. <br />A revised offer package will be submitted within 90 days of resolution of the policy decisions. <br />The following conditions were discussed with the city attorney's office and are consistent <br />with City efforts on prior projects. These conditions for any agreement would facilitate <br />relocation to a new development site: <br />a) Acquisition of each parcel will be individually negotiated between the property owner <br />and the City. Upon completion of the acquisition, the property owner would become a <br />tenant of the City until construction of the replacement site is complete. <br />b) The revised offer to Coalition members shall include acquisition, relocation, FF &E, and <br />moving. <br />c) Purchase of the relocation site will be by an entity established by the Coalition members. <br />This entity would have exclusive right to purchase remnant parcels associated with the <br />new development site for 6 months from the date City takes possession of these parcels. <br />d) The price per square foot of the new development site shall be determined via appraisal <br />prepared by a licensed appraiser. <br />e) Purchase of the City property is contingent on agreement of all the Coalition members. <br />3. Infrastructure credits <br />Water and sewer capacity fees are credited to relocations based on capacities that are <br />traded. The remnant parcel for a new developer would pay full capacity fees. <br />4. Business owners are to retain their existing property tax base. <br />Property tax issues and increases are not within the City's jurisdiction. Property taxes are <br />outlined in the Revenue and Taxation code.
