Within ten (10) <br />days of the date of mailing plus two (2) days for mail service, the applicant(s) <br />may appeal the decision denying the Business License to the City Council. The <br />request for appeal shall be in writing, shall set forth the specific ground(s) on <br />which it is based and shall be submitted to the Business Licensing division with a <br />copy submitted to the clerk of the City Council. The applicant shall, along with <br />the appeal requested submitted to the Business Licensing division, include an <br />appeal deposit in an amount of $1,000.00. <br />D. The City Council shall conduct a hearing on the appeal or refer the <br />matter to a hearing officer, pursuant to hearing provisions of this Code, within <br />thirty (30) business days from the date the completed request for appeal was <br />received by the Business Licensing division, except where good cause exists to <br />extend this period. The appellant shall be given at least ten (10) business days <br />written notice of such hearing. The hearing and rules of evidence shall be <br />conducted pursuant to the hearing rules set forth in this Code and in accordance <br />with state law. The determination of the City Council on the appeal shall be final. <br />_.050 Medical Marijuana Collective Operating Restrictions and <br />Prohibitions. <br />All person(s) or entities operating as a Medical Marijuana Collective in the <br />City shall comply with the following Operating Restrictions and Prohibitions. A <br />Business License issued by the City for a Medical Marijuana Collective does not <br />authorize or permit the operation of such entities. The sole purpose of this <br />Chapter is to limit and restrict the operations of such entities. <br />A. The Property location of a Medical Marijuana Collective or any entity <br />that provides medical marijuana pursuant to any provision of state law is <br />I restricted to commercial and industrial zones as defined in this Code. <br />I <br />04202014-Re MD <br />
