Should later <br />enacted state law provide for access to and use of marijuana for recreational and <br />non - medical purposes, this section shall not apply to individuals using or <br />accessing marijuana for non - medical reasons. <br />100 Violation and enforcement. <br />A. Any person violating any provision of this Chapter or knowingly or <br />intentionally misrepresenting any material fact in procuring a Business License <br />under this Chapter, shall be deemed guilty of a misdemeanor punishable by a <br />fine of not more than one thousand dollars ($1,000.00) or by imprisonment for <br />not more than twelve (12) months, or by both such fine and imprisonment. Each <br />and every day a violation occurs shall be considered a separate violation. <br />B. Any person who engages in any Medical Marijuana Collective <br />operations after a Business License application has been denied, or a Business <br />License has been suspended or revoked, and before a new Business License is <br />issued, shall be guilty of a misdemeanor punishable by a fine of not more than <br />one thousand dollars ($1,000.00) or by imprisonment for not more than twelve <br />(12) months, or by both such fine and imprisonment. <br />C. Any person who or entity that facilitates the operation of a Medical <br />Marijuana Collective without a Business License shall be guilty of a misdemeanor <br />punishable by a fine of not more than one thousand dollars ($1,000.00) or by <br />imprisonment for not more than twelve (12) months, or by both such fine and <br />imprisonment. <br />D. As a nuisance per se, any violation of this Chapter shall be subject to <br />injunctive relief, revocation of the Certificate of Occupancy for the property, <br />disgorgement and payment to the City of any and all monies unlawfully obtained, <br />costs of abatement, costs of investigation, attorney fees, and any other relief or <br />25 <br />04202014 -RE V30 <br />
