AGREEMENT INCORPORATING COMMUNITY <br />DEVELOPMENT BLOCK GRANT REQUIREMENTS <br />FOR LANDSCAPE ARCHITECTURE CONSULTING <br />SERVICES WITH RJM DESIGN GROUP <br />THIS AGREEMENT made and entered into this 16p1i day of September, 2014 by and <br />between RJM Design Group, a California corporation (hereinafter "Consultant'), and the City of <br />Santa Ana, a charter city and municipal corporation organized and existing under the <br />Constitution and laws of the State of California (hereinafter "City "). <br />RECITALS:. <br />A. The City issued a Request for Proposals ( "RFP ") on June 18, 2014, for a competitive <br />bidding process to hire a consultant to perform landscape architectural design services <br />including the preparation of plans, specifications and a cost estimate for the Pacific <br />Electric Park project ( "Project "). <br />B. Consultant was chosen through this competitive process after submitting its Proposal <br />and being evaluated as the most experienced candidate for the job, through a fair <br />competitive selection process consistent with Govermnent Code section 4524.12 and <br />consistent with the federal rules of procurement. <br />C. The City, as an entitlement recipient and grantee of the United States Department of <br />Housing and Urban Development ( "HUD ") Community Development Block Grant <br />( "CDBG ") Program, desires to enter this Agreement with the Consultant for the <br />expenditure of CDBG funds in accordance with Title 24, Part 570 of Code of Federal <br />Regulations 24 CFR 570.000, et seq, ( "CDBG Reg's "), to pay for the landscape <br />architectural design services relating to the Project. <br />1), In undertaking the performance of this Agreement, Consultant represents that it is <br />knowledgeable in its field and that any services performed by Consultant under this <br />Agreement will be performed in compliance with such standards as may reasonably be <br />expected from a professional consulting firm in the field. <br />NOW THERE, ORE, in consideration of the mutual and respective promises, and subject to the <br />terms and conditions hereinafter set forth, the parties agree as follows: <br />SCOPE OF SERVICES <br />Consultant shall perform landscape architectural design services for the Pacific Electric <br />Park Project, as set forth in Appendix A, Scope of Work, from the City's Request for Proposals <br />issued June 18, 2014, attached hereto as Exhibit A and the Consultant's Proposal for Professional <br />Design Services dated July 17, 2014, attached hereto as Exhibit B, All Exhibits to this <br />Agreement are incorporated by reference. <br />EXHIBIT 1 <br />25D -3 <br />
