VARIANCE NO. 2014 -05 <br />4. <br />(Applicant: 24 Hour Fitness) <br />Legal noticed published in the Orange County Reporter on August 12, 2014 and <br />notices mailed August 13, 2014. <br />A project overview was provided by Ali Pezeshkpour, Assistant Planner I. Chairman <br />Alderete opened the public hearing. The applicant thanked the Planning <br />Commission for their time and attention to the matter. There were no speakers and <br />the hearing was closed. <br />Adopt a resolution approving Variance No. 2014 -5 as conditioned. <br />MOTION: Yrarrazaval SECOND: Nalle <br />VOTE: AYES: Alderete, Bacerra, Bauer, Gartner, Mill, Nalle, Yrarrazaval (7) <br />NOES: None (0) <br />ABSTAIN: None (0) <br />ABSENT: None (0) <br />CONDITIONAL USE PERMIT NOS. 2013-32,2013-33, and 2013 -34 <br />(Applicant: Fourth Street Market) <br />Legal noticed published in the Orange County Reporter on August 12, 2014 and <br />notices mailed August 13, 2014. <br />A project overview was provided by Hally Soboleske, Associate Planner. Chairman <br />Alderete opened the public hearing. Planning Commission discussion ensued <br />regarding the floor plan and fire safety concerns with the patio seating in the private <br />alley, the proposed use of the building, and the prior use at the space. Written <br />communication was received from Cynthia Li regarding potential after hour noise <br />concerns. The applicant fielded additional questions from the Planning Commission. <br />There were no speakers and the hearing closed. <br />MOTION: <br />1. Adopt a resolution approving Conditional Use Permit No. 2013 -32 to allow a <br />Type 47 ABC license. <br />2. Adopt a resolution approving Conditional Use Permit No. 2013 -33 as <br />conditioned to allow business operations until 2:00 a.m. <br />3.
