Memorandum of Understanding <br />Between <br />The City of Anaheim, CA <br />and <br />The City of Santa Ana, CA <br />On Administering <br />The Housing Opportunities for Persons with AIDS Program (HOPWA) <br />This Memorandum of Understanding (MOU) establishes a Grantee - Administrative Sub- recipient Agent <br />relationship between the City of Anaheim, CA and the City of Santa Ana, CA. <br />BACKGROUND AND PURPOSE <br />The City of Anaheim is the formula grantee for Orange County CA Eligible Metropolitan Statistical <br />Area (EMSA) under the U.S. Department of Housing and Urban Development (HUD) Housing <br />Opportunities for Persons with AIDS program ( HOPWA) authorized under the AIDS Housing <br />Opportunity Act, 42 USC 12901 et sea., and the HOPWA program regulations, 24 CFR Part 574, <br />which are incorporated into this Agreement. Under Section 574.500, HOPWA Grantees are <br />responsible for ensuring that grants are administered in accordance with the HOPWA regulations <br />and other applicable laws. This responsibility cannot be delegated to project sponsors. Grantees <br />may, however, provide HOPWA funds to project sponsors to carry out eligible activities. A "project <br />sponsor" means any non - profit organization or governmental housing agency that receives HOPWA <br />funds from the grantee to carry out eligible activities identified in the approved grant application. <br />Grantees may also utilize administrative Sub - recipient organizations to assist ONLY in the <br />implementation, administration and oversight of the HOPWA grant with the direct services project <br />sponsors and other program sub - recipients. <br />In accordance with this MOU, the City of Santa Ana's Community Development Department will be the <br />Administrative Sub - recipient Agent for the City of Anaheim for the purpose of carrying out HOPWA <br />eligible activities, including activities related to administering HOPWA funds awarded by HUD to the City <br />of Anaheim. <br />Together, the parties enter into this MOU to ensure that HOPWA funds subject to this Agreement are <br />used effectively and efficiently in accordance with HOPWA program regulations and other applicable <br />laws. <br />f <br />This MOU applies to the following uncommitted HOPWA funds awarded by HUD to the City of Anaheim: <br />Grant Number <br />Program Year <br />Uncommitted Amount <br />CAH14FO10 <br />FY 2014 -15 <br />$1,536,466 <br />
