Market Rate Unit means any unit in the Project that is not restricted for rental <br />and occupancy by Eligible Tenants. <br />Median Income is calculated by HCD using non - aggregated census income data <br />and applying trending factors for metropolitan statistical areas (MSA) throughout <br />the country. The MSA for Santa Ana is Orange County. <br />Ordinance means the Housing Opportunity Ordinance adopted by the City <br />Council on November 28, 2011, which is codified in Article XV111.1 Section 41- <br />1900 et seq. of the City's Municipal Code. <br />Party and Parties mean the City and the Property Owner as parties to this <br />Inclusionary Housing Agreement. <br />Program Director has the day -to -day authority for making determinations <br />related to the Ordinance and the Draft Manual. The Program Director will be <br />appointed by the Executive Director. <br />Project means the rental housing project proposed to be developed on the <br />Property at the Property Owner's sole cost and expense. <br />Property means the real property on which the Project is to be developed, for <br />which the legal description is provided in Exhibit 1 to the Inclusionary Housing <br />Agreement. <br />Property Owner shall mean the owner of the Project that includes Inclusionary <br />Units. <br />Recordation Date means the date of recording in the Official Records of the <br />County of Orange, California of this Inclusionary Housing Agreement. <br />Utilities Allowance shall mean the Utility Allowance Schedule published <br />annually by the Orange County Housing Authority. <br />— — — — _.— .._.__......------- ....._._. <br />Inclusionary Housing Agreement — Rental Project Page 8 <br />City of Santa Ana September 18, 2014 <br />19H -10 <br />
